Title: 2025 Patent Law Update: What Inventors and Businesses Need to Know

Published by Patent 360 | June 30, 2025

The United States Patent and Trademark Office (USPTO) has introduced several noteworthy updates in 2025 that impact how inventors and companies should approach patent filings. Whether you're an entrepreneur launching a new product or a company managing an IP portfolio, staying informed can help you maintain a competitive edge and avoid costly setbacks.

1. Updated USPTO Fee Schedule (Effective May 2025)

The USPTO has implemented a revised fee structure affecting both utility and design applications. Key changes include:

  • Increases in filing, search, and examination fees for large entities.

  • Discounted micro-entity and small-entity rates remain available—but require updated certifications.

  • New surcharge for late IDS (Information Disclosure Statement) submissions after first Office Action on the merits.

2. Faster Examination Under Expanded PPH Program

The Patent Prosecution Highway (PPH) has been expanded with new participating countries and streamlined request procedures. If you've already received a favorable result in a partner office (e.g., EPO, JPO), you can now fast-track your U.S. application with fewer delays.

Patent 360 Tip: We can guide you through using the PPH for your foreign-to-U.S. patent strategy.

3. Revised Guidance on 35 U.S.C. § 101 (Patent Eligibility)

The USPTO has issued new examiner guidelines narrowing the scope of abstract idea rejections. This update benefits software, AI, and biotechnology-related patents.

Practical Impact: Applicants now have stronger arguments when facing Section 101 rejections, particularly in method and system claims.

4. Track One Prioritized Examination Remains in High Demand

Track One (expedited patent examination) continues to be the most effective tool for obtaining a patent within 12 months. Due to popularity, the USPTO advises applicants to file early in the fiscal year to avoid the annual cap.
